By accessing and using Resilient Servers' services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
Resilient Servers provides virtual private server (VPS) and dedicated server hosting solutions. The specific features, resources, and technical specifications of each service are detailed in your service agreement and order confirmation.
3.1. You must provide accurate and complete information when registering for our services.
3.2. You are responsible for maintaining the confidentiality of your account credentials.
3.3. You are solely responsible for all activities that occur under your account.
4.1. Resilient Servers strives to maintain 99.9% uptime for all services, excluding scheduled maintenance.
4.2. We reserve the right to perform scheduled maintenance with advance notice.
4.3. Service level agreements (SLAs) are provided based on your specific subscription plan.
5.1. All payments are due in advance of the service period.
5.2. Prices are subject to change with 30 days' notice.
5.3. Accounts with outstanding balances may be suspended until payment is received.
5.4. Refunds are subject to our refund policy as outlined in section 6.
6.1. VPS and dedicated server services may be eligible for a refund within 7 days of purchase if you are not satisfied.
6.2. Setup fees, domain registration fees, and custom configurations are non-refundable.
6.3. Accounts terminated due to violation of our Acceptable Use Policy are not eligible for refunds.
7.1. You agree not to use our services for any illegal or unauthorized purpose.
7.2. Prohibited activities include but are not limited to:

8.1. Your service plan specifies the allocated resources (CPU, RAM, storage, bandwidth).
8.2. Excessive resource usage beyond plan limits may result in service degradation or temporary suspension.
8.3. Additional resources may be purchased as needed.
9.1. While we maintain server-level backups, you are responsible for backing up your own data.
9.2. We do not guarantee the integrity or availability of client data backups.
9.3. Data recovery services may be available for an additional fee.
10.1. Services are provided for the term specified in your service agreement.
10.2. You may cancel your service at any time by providing written notice.
10.3. We reserve the right to terminate services for violation of these Terms and Conditions.
11.1. All content, trademarks, and service marks displayed on our website are the property of Resilient Servers or their respective owners.
11.2. You retain all rights to your own content stored on our servers.
12.1. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services.
12.2. Our maximum liability is limited to the amount paid for the service during the previous 12 months.
You agree to indemnify and hold harmless Resilient Servers and its affiliates from any claims, damages, or expenses arising from your use of our services or violation of these Terms and Conditions.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which ALYASSER INFORMATION SERVICES OÜ is registered, without regard to its conflict of law provisions.
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of the modified terms.
